Privacy Policy of Meitu

IMPORTANT:

MEITU RESPECTS AND PROTECTS THE PRIVATE INFORMATION OF ALL USERS WHO USE THE SERVICES OFFERED BY MEITU. MEANWHILE, MEITU WILL PROTECT USER’S PRIVATE INFORMATION IN STRICT ACCORDANCE WITH THE PROVISIONS OF THE PRIVACY POLICY. UNLESS OTHERWISE STIPULATED IN THE PRIVACY POLICY, MEITU WILL NOT DISCLOSE OR PROVIDE THE USER’S PRIVATE INFORMATION TO ANY THIRD PARTY WITHOUT PRIOR CONSENT OF THE USER. THE PRIVACY POLICY (HEREINAFTER REFERRED TO AS THE “POLICY”) IS AN INTEGRAL PART OF THE USER AGREEMENT OF THE PRODUCT. THE CONCEPTS NOT MENTIONED OR EXPRESSLY INDICATED IN THE POLICY SHALL BE SUBJECT TO THE USER AGREEMENT. THEREFORE, PLEASE CAREFULLY READ AND CHOOSE TO ACCEPT OR NOT ACCEPT THE POLICY (UNDERAGED USERS SHALL READ IN THE COMPANY OF THEIR LEGAL GUARDIANS). UNLESS YOU ACCEPT ALL TERMS OF THE POLICY, YOU HAVE NO RIGHT TO REGISTER, LOG IN OR USE RELEVANT SERVICES VOLVED IN THE POLICY. BY REGISTERING, LOGGING IN, USING THE SERVICES OR CARRYING OUT OTHER ACTIONS, YOU SHALL BE DEEMED TO HAVE ACCEPTED THE POLICY AND AGREED TO ACCEPT THE CONSTRAINTS OF ALL TERMS OF THE POLICY.

I. Applicable Scope

THE POLICY WILL ENUMERATE ALL USER INFORMATION THAT MAY BE INVOLVED AND COLLECTED BY ALL PRODUCTS, OF WHICH MEITUHAS LAWFUL OPERATING PERMISSION. BUT IT DOES NOT MEAN THAT MEITU NECESSARILY NEEDS TO COLLECT ALL INFORMATION ACCORDING TO THE APPLICABLE SCOPE PROVIDED IN THIS CLAUSE. ONLY WHEN YOU USE SPECIAL FUNCTIONS OR SERVICES CAN CORRESPONDING USER INFORMATION COLLECTION BE TRIGGERED ACCORDING TO THE FOLLOWING OPERATING METHODS AND SCOPE.

(I) Information You Provide Us

Personal information as provided by you toMeitu, including but not limited to photos, names, date of birth, and other personal information, and true identity authentication based on the mobile telephone number and the equivalent towards the registered user by Meitu under the principle of “backstage real name and foreground voluntariness” specified in the Application Program Information Service Management Regulation for Mobile Internet where you are required to register an account of Meitu.

(II) We may collect the following information.

1) Cookies and similar technologies. When Meitu requests an advertiser or other partner to deliver ads or offer services to your equipment, Meitu or the third party may apply cookies and similar technologies;

2) Equipment or software information, such as the configuration information provided by your mobile equipment, web browser or other programs used to access our services, your IP address and the version and IMEI of the mobile equipment used, operating system information and network information;

3) Information relating to the mobile applications (APP) and other software that you have used, and the content from such mobile applications and software that you have used.

4) Information (metadata) involving the contents that you share through our services, such as the date, time, place and others of shooting and sharing the photo or video.

(III) Functional Requirements

According to the product requirements, Meitu will activate your camera, access your photo album and save images, initiate sound recording and camera to carry out video recording and activate other relevant functions of your mobile equipment to ensure the normal use of the product.

II. Exceptions

The Privacy Policy is applicable for all services offered by the platform of Meitu. But when third parties (such as brand owners, merchants) provide services to you by relying on the platform of Meitu, the personal privacy and information that you provide to third parties shall not be included in the protection scope of the Privacy Policy.

III. How will we use user information?

Meitu collects user information to improve product performance and user experience. In order to achieve such an aim, Meitu will use the user information for the following purposes:

(I) To improve product functionality and upgrade user experience, thereby offering better services for the user;

(II) For identity verification, security control and customer services, so as to ensure the normal use and security of Meitu;

(III) To enable Meitu to better understand the interests of the user to help Meitu to respond to user’s individual demands;

(IV) Meitu may use the user’s personal information to prevent, find and investigate the practices of fraud, endangering of security, illegal actions or other conduct violating the agreement, policy or rules between the user and Meitu or its associated parties, so as to protect the legitimate rights and interests of Meitu or its associated parties;

(V) To enable the user to participate in the surveys of Meitu’s relevant products and services.

IV. Information Security Assurance

Meitu will apply various security technologies and programs to establish a complete management system, so as to protect user’s personal information from unauthorized access, use or disclosure. Unless otherwise provided by laws and regulations, Meitu will not publicize or disclose your personal information to any third party without your permission.

V. Information Disclosure and Use

Notwithstanding any provision in the Privacy Policy, when one of the followingcircumstances occurs, Meitu is entitled to reserve or disclose all or part of user information:

(I) To comply with the provisions of laws, regulations and normative documents, or follow the requirements of government authority or juridical organ;

(II) To protect the safety of others’ person or property;

(III) To avoid or solve fraud, network security or major technical problems;

(IV) To maintain the legitimate rights and interests of Meitu.

However, any term of the Privacy Policy shall not restrict the right of defense that the law grants to the user in any sense.

VI. Special Exemptions

The user shall understand and agree that, in case of the occurrence of circumstances not due to the fault of Meitu, Meitu shall not be held liable for the disclosure of the user’s personal information and the damages caused thereby.

(I) Any personal information disclosed, lost, stolen or tampered with as a result of a hacker attack, computer virus invasion or outbreak, temporary shutdown due to government regulation or other force majeure events affecting the normal operation of network, etc.

(II) The personal information disclosed when linking to other websites or accepting services from third parties in the course of using the service provided by Meitu, resulting in any legal dispute orother consequence.
