Your use of BeautyCam is subject to these Terms of Services (these "Terms"). Thank you for reviewing these Terms – we hope you enjoy using BeautyCam.
“BeautyCam” refers to a software application developed by and all related services ("Services") provided by or on behalf of BeautyCam, Inc. and its controlled or affliate companies (Collectively "we", "us", "our").
For all purposes of these Terms, “You” refers to the user of BeautyCam anywhere in the world, except if you belong in any of the following categories: (i) a user of BeautyCam in the People's Republic of China; or (ii) a citizen of the People's Republic of China using BeautyCam anywhere in the world. If you belong in any of these categories, please refer to the BeautyCam – Terms of Service (PRC Users) for the terms that apply to you.
IF YOU ARE UNDER THE AGE OF 13, YOU MUST NOT USE BEAUTYCAM. IF YOU ARE BETWEEN THE AGE OF 13 AND 18 OR RELEVANT AGE IN YOUR JURISDICTION WHERE YOU ARE CONSIDERED AS A MINOR, YOUR PARENT OR GUARDIAN, BOTH THEMSELVES AND ON YOUR BEHALF, MUST AGREE TO THESE TERMS BEFORE YOU CAN USE BEAUTYCAM.
These Terms govern the relationship between you and us in regard to your use of BeautyCam. Before accessing or using BeautyCam, including accessing a mobile App and a PC application, you must agree to these Terms, our Privacy Policy and any other policies available in BeautyCam.
BY INSTALLING, USING OR OTHERWISE ACCESSING BEAUTYCAM, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT INSTALL, USE, OR OTHERWISE ACCESS BEAUTYCAM. THE USE OF BEAUTYCAM IS VOID WHERE PROHIBITED.
We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms, our Privacy Policy, and any other policies available in BeautyCam at any time by incorporating the amended terms in BeautyCam. You will be deemed to have accepted such changes by continuing to use BeautyCam. If at any point you do not agree to any portion of the then-current version of these Terms, our Privacy Policy, or any other policies, relating to your use of BeautyCam, your license to use BeautyCam shall immediately terminate, and you must immediately stop using BeautyCam.
Subject to your agreement and continuing compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to access and use BeautyCam for your own non-commercial purposes. You agree not to use BeautyCam for any other purpose.
You must comply with these Terms and any policy available in BeautyCam during your use of BeautyCam and only use BeautyCam as permitted by applicable laws and regulations, wherever you may be when you use BeautyCam. For example, you agree that you will not, under any circumstances, use BeautyCam to produce, store and make public, any content infringing upon any third party‘s rights to its reputation, portraiture, privacy, design, trademark and any other lawful rights.
Using BeautyCam does not give you the ownership of our intellectual property rights in BeautyCam. All rights, title and interest in and to BeautyCam (including, but not limited to, any program, any future updates, computer code, themes, objects, characters, in-side design and artwork, image setting profile information, trademark visual effects, user interfaces, functionality, methods of operation, trademark, titles, moral rights, documentation and so on) are owned by us and our licensors. We reserve all rights, including, but not limited to, all intellectual property rights or other proprietary rights, in connection with BeautyCam and the Services. As expressly provided in these Terms, you must accept that you have no rights to our intellectual property, in particular to the use of our trademarks, product names, domain names or any other distinctive brand features.
WE RESERVE THE RIGHT TO DETERMINE WHAT CONDUCT WE DEEM TO BE IN CONFLICT WITH THE SPIRIT OR INTENT OF BEAUTYCAM AND ALL RELATED SERVICES OR MAKE IMPROPER USE OF BEAUTYCAM.
We value your privacy. Our Privacy Policy explains how we treat your personal data and protect your privacy when you use BeautyCam. By using BeautyCam, you agree that we can use such data in accordance with our Privacy Policy.
We do not claim ownership of the content that you process, submit, share or post in BeautyCam and you retain ownership of any intellectual property rights that you hold in that content ("Your Content"). You understand and agree that you give us (and those we work with) a free-of-charge, non-exclusive, worldwide license to use Your Content solely for the purpose of providing, promoting, developing and improving the Services in BeautyCam, including new services that we may provide in the future. Your such license will be in no event be deemed as a misuse of Your Content and a transfer of any intellectual property rights of Your Content. In other words, what belongs to you is yours. All such use will be in strict compliance with our Privacy Policy.
You are solely responsible for Your Content. You must at all times ensure that: (i) you have the rights required to process, submit, share or post Your Content, and to grant us the rights as set out in these Terms; and (ii) our use of Your Content in accordance with these Terms does not infringe upon or violate the rights of any person or otherwise contravene any applicable laws or regulations.
BeautyCam may contain advertising or commercial content. You understand and agree that we are allowed to integrate, display and otherwise communicate advertising or commercial content in BeautyCam as some of our Services will be supported by advertising revenue. As explained in more detail in our Privacy Policy, you further agree that we may use targeted advertising to try to make advertising more interesting and valuable to you.
Although it is our intention for the Services in BeautyCam to be available as much as possible, there will be occasions when the Services in BeautyCam may be at our sole discretion suspended or terminated, including, but not limited to, for scheduled maintenance or upgrades, for emergency repairs, for our sole business strategy shift. Where reasonably practicable, we will give you notice of any suspension or termination. Notwithstanding the abovementioned, we will under no circumstances be held liable to you for any loss and cost arising from or in connection with the suspension and/or termination of our Services in BeautyCam. We recommend that you keep a backup copy of Your Content at all times.
BEAUTYCAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND NEITHER WE NOR OUR AFFILIATE COMPANIES NOR ANY OF OUR EMPLOYEES, MANAGERS, OFFICERS OR AGENTS MAKE ANY REPRESENTATIONS OR WARRANTIES OR UNDERTAKINGS OF ANY KIND WHATSOEVER, EXPLICITLY OR IMPLIED, AS TO, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF SERVICES. TO THE EXTENT PERMITTED BY LAWS AND REGULATIONS, WE EXCLUDE ALL WARRANTIES.
TO THE EXTENT PERMITTED BY LAWS AND REGULATIONS, WE SHALL IN NO EVENT BE LIABLE TO YOU FOR DAMAGES FOR LOSS OF REVENUES OR PROFITS, LOSS OF GOODWILL OR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SPECIAL DAMAGES IN CONNECTION WITH BEAUTYCAM AND THE SERVICES, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE AGGREGATE LIABILITY OF BEAUTYCAM FOR ALL CLAIMS FOR ANY LOSS, DAMAGE OR INDEMNITY WHATSOEVER RESULTING FROM YOUR USE OF BEAUTYCAM SHALL IN NO CASE EXCEED THE AMOUNT THAT YOU HAVE PAID TO US FOR YOUR USE OF BEAUTYCAM TO WHICH THE CLAIM RELATES IN THE 6 MONTHS IMMEDIATELY PRECEDING THE DATE OF THE MOST RECENT CLAIM.
These Terms, including, but not limited to, its conclusion, validity, construction, performance and settlement of the disputes, shall be governed by the law of the Hong Kong Special Administrative Region, without giving effect to the principles of conflict of law. Any dispute arising from, or in connection with the Contract shall be first settled through friendly negotiation between You and us. In the case where no settlement to disputes can be reached through amicable negotiation, the disputes shall then be submitted to Hong Kong International Arbitration Centre under the Hong Kong International Arbitration Centre Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of the arbitration will be Hong Kong. The arbitration proceedings will be conducted in English. The arbitral award is final and binding upon both parties. The arbitration fees shall be borne by the losing one except otherwise awarded by the arbitration commission.
These Terms may be translated in various languages and the English version of these Terms shall prevail and override.
We may notify you via postings in BeautyCam, and via e-mail or any other communications means, based on the contact information you provide to us. All notices given by you or required from you under these Terms or our Privacy Policy shall be in writing and addressed to: BeautyCam, Inc. Attn: Legal, Unit 8106B, 81/F, International Commerce Center, 1 Austin Road West, Kowloon, Hong Kong. Any notices that you provide without compliance with this Section on Notices shall have no legal effect.
If you are a user of BeautyCam in the United States of America, the following terms are incorporated into these Terms, and override these Terms to the extent of any inconsistency that occurs
If you are a California resident, you agree to waive California Civil Code Section 1542, and any similar provision in any other jurisdiction (if you are a resident of such other jurisdiction), which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favour at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor."
EACH OF YOU AND US HERETO IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE TRANSACTIONS CONTEMPLATED HEREBY.

In order to provide better Services to you, Meitu may collect, to the extent permitted by laws and only when using certain functions and Services, the following data and information.
When using our Services, we might recommend you sign up for a Meitu account to take full advantage of our Services and their features. When you do, we will collect the information you provide to identify you for the purpose of the register of your Meitu account, including your account name, mobile phone number and so on，which are necessary to sign up for a Meitu account.
When you use any of Meitu applications on a mobile platform, we may collect and record certain information such as your unique device ID (persistent /non-persistent), hardware type, media access control ("MAC") address, international mobile equipment identity ("IMEI"), the version of your operating system ("OS"), your device name, and your location (based on your Internet Protocol ("IP") address, country code of SIM and GPS). This information is useful to us for troubleshooting and helps us understand usage trends among all users.
We may collect your location based information for the purpose of providing you with a correct version of the application and our better Services. Except otherwise provided in the Policy, we will not share this information with any third party. If you no longer wish to allow us to track or use such information, you may turn the internet access and/or GPS off at the device level or disable the relevant permission to our application.
In addition, we may create a unique user ID to track your use of our Services. This unique user ID is stored in connection with your profile information to track the Meitu applications you are using.
When using our Services, including engaging with, watching or producing any content in relation to our Services, certain user log information in Meitu applications will be automatically collected, including (i) details on when and how often our Services are being used, (ii) devices statistics, critical operation paths, errors, crashes, language and time zone and so on. These user logs are used to improve our Services and are NOT USED to identify and track our users individually.
Metadata is usually technical data that is associated with user content ("Content") and can describe what, when, where, how, and by whom a piece of Content has been generated. When using our Services, we will use the metadata of the photos to provide more precise functions of “Facial Detection”, “Key-Points Recognition”, “Region Segmentation”, “Content Tags” and the other customized function on the basis of the combination of the mentioned basic functions. This metadata is used to improve our Services and is NOT USED to identify and track our users individually.
Some of our Sites or applications offer publicly accessible community forums. You should be aware that any information you provide and make public in these areas may be read, collected, and used by others who access our Sites. If you cannot remove your personal information from our community forum by yourself, please contact us at support@meitu.com or legal@meitu.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
We may collect and use information about you, such as your device identifier, MAC address, IMEI, geo-location information and IP address for the purpose of the tracking of the advertising. This information is used together to create a unique user number to help us to better count and track advertising based on language, geographic location and other relevant details. This information is NOT SOLD to outside parties.
Our Services may contain third party tracking tools from third party service providers. Such third parties may use cookies, APIs, and SDKs in our Services to enable them to collect and analyze your information on our behalf. The third parties may have access to information such as your device identifier, MAC address, IMEI, locale (specific location where a given language is spoken), geo-location information, and IP address for the purpose of providing their services under their respective privacy policies. The Policy does not cover the use of tracking tools from third parties. We do not have access or control over these third parties. You understand and agree that (i) we may collect and store your information, as outlined in this Policy, within servers located in the People’s Republic of China (“PRC”), as well as other countries, and that this process would include international transfer of your information; and (ii) we may transfer information that we collect about you to our affiliate companies or to other third parties (please refer to “Third Party Services” in this Policy) across borders according to this Policy. 2.知识产权声明：美颜相机本身自带的所有版本、技术、程序、素材和所有的信息内容（“美图信息内容”，包括但不限于产品功能、用户界面、操作步骤、商标、专利、计算机软件作品）的知识产权均归美图公司所有，美图公司对您的软件使用许可在任何情况下均不应视为向您转让美图知识产权的部分或者全部。您通过美颜相机下载、使用的任何素材及其他美图信息内容，仅限您个人娱乐、学习、研究或者欣赏使用，未经美图公司书面同意，不可用于任何商业用途。
3．您的必要授权：您利用美颜相机拍摄或者制作的信息内容中所含有的知识产权归您所有。您同意授予美图公司一项为提供本服务、优化本服务和宣传推广本服务之目的所必须的免费、非独占、不可撤销的可在全球范围内使用您在本服务过程中产生信息内容的权利。美图将尽最大努力在合理范围内使用上述信息内容，且您的必要授权并不代表美图公司对上述信息内容的必然使用，也不改变您对上述信息内容的所有权及其知识产权归属，更不影响您对上述内容信息任何合法使用。
4.个人信息保护：保护您的个人信息是美图公司的一项基本原则。美图公司将按照本协议及《美图公司隐私政策》的规定收集、使用、存储和管理您的个人信息。
5.您的合法使用：您应对使用美颜相机所拍摄、制作、发布或者储存的图片等数据信息的真实性、合法性负责。您不得使用美颜相机制作、储存或发布如下信息内容：
6.广告业务许可：美颜相机中可能包括广告，这属于美图公司合理合法的商业模式，您同意在使用美颜相机过程中接收由美图公司与第三方合作伙伴发布的广告信息。
7.不可抗力与其他免责事由：美颜相机在使用中会受到包括但不限于如下不可抗力或者其他因素的影响：政治原因、社会环境、自然灾害、经济危机、计算机病毒或黑客攻击、服务器或系统不稳定、您所在的特殊位置、任何技术能力、网络质量以及通信线路、计算机故障等（以下统称“免责事由”）。若出现上述免责事由情况时，美图公司将尽努力在第一时间进行修复或者及时补救，给您造成损失的，美图公司在适用法律与政策允许的范围内免责。
8.适用法律与政策：与本协议有关的事项，均应适用中华人民共和国（但不含港澳台地区）的法律与政策（ “适用法律与政策”）。该等适用法律与政策可能处于动态变化过程中，因此，若因适用法律与政策发生变化，导致您和/或美图公司在本协议项下的权益有所增减，均不构成本协议的全部或某个条款自然无效或终止可执行性的依据，除非发生变化的该等适用法律与政策属于效力性强制性规定。
9.法律纠纷管辖：若在您与美图公司之间出现了与本协议和/或与美颜相机有关的法律纠纷，只要发生纠纷时本协议适用法律与政策允许将厦门美图网科技有限公司所在地作为唯一或其中之一的纠纷管辖地的，则您同意由厦门美图网科技有限公司所在地有管辖权的人民法院排他管辖该纠纷。

为了向您提供更好的服务，我们将在法律允许的范围内和当且仅当您使用某些功能或者服务时，收集您的相关数据和信息。
在您使用我们的服务时，我们可能建议您注册一个美图帐号，以方便您充分利用我们的服务及其优势。当您注册美图帐号时，我们会收集您所提供的可识别您身份的信息，这些信息包括您的帐号名、移动电话号码等注册美图帐号所必须的信息。

1.本協議及定義：
2.智慧財產權聲明：美顏相機本身內建的所有版本、技術、程式、素材和所有的資訊內容（“美圖資訊內容”，包括但不限於產品功能、使用者介面、操作步驟、商標、專利、電腦軟體作品）的智慧財產權均歸美圖公司所有，在任何情況下，美圖公司對使用者的軟體使用許可均不應視為向使用者轉讓美圖智慧財產權的部分或全部。使用者透過美顏相機下載、使用的任何素材及其他美圖資訊內容，僅限使用者個人娛樂、學習、研究或欣賞使用，未經美圖公司書面同意，不得用於任何商業用途。
3.必要授權：使用者利用美顏相機拍攝或者製作的資訊內容中所含有的智慧財產權歸使用者所有。使用者同意授予美圖公司一項為提供本服務、優化本服務和宣傳推廣本服務之目的所必須的免費、非獨占、不可撤銷，且可在全球範圍內使用使用者在本服務過程中產生資訊內容的權利。美圖將盡最大努力在合理範圍內使用上述資訊內容，且使用者的必要授權並不代表美圖公司務必使用上述資訊內容，亦不會改變使用者對上述資訊內容的所有權及其智慧財產權之歸屬，更不影響使用者對上述內容資訊任何合法使用。
4.個人資料保護：保護使用者的個人資料是美圖公司的一項基本原則。美圖公司將按照本協議及《美圖公司隱私政策》的規定收集、使用、儲存和管理使用者的個人資料。
5.合法使用：使用者應對使用美顏相機所拍攝、製作、發佈或儲存的圖片等資料、資訊的真實性、合法性負責。使用者不得使用美顏相機製作、儲存或發佈以下資訊內容：
如使用者有上述違法或侵害他人合法權利的行為，美圖公司有權立即採取適當措施，包括但不限於：刪除違法資訊內容、終止對使用者的軟體使用許可並停止所有技術服務、訴諸執法機構或司法機關等。若因使用者違法或不當使用美顏相機而造成的自身損失或對美圖公司和/或協力廠商造成損害，使用者須自行承擔所有責任。
6.廣告業務許可：美顏相機中可能包括廣告，這屬於美圖公司合理合法的商業模式，使用者同意在使用美顏相機過程中接收由美圖公司與協力廠商合作夥伴發佈的廣告資訊。
7.不可抗力與其他免責事由：使用美顏相機中會受到下列不可抗力或者其他因素的影響，包括但不限於：政治原因、社會環境、自然災害、經濟危機、電腦病毒或駭客攻擊、伺服器或系統不穩定、使用者所在的特殊位置、任何技術能力、網路品質以及通訊線路、電腦故障等（以下統稱“免責事由”）。若出現上述免責事由情況時，美圖公司將盡力在第一時間進行修復或及時補救，美圖公司在適用法律與政策允許的範圍內對使用者所造成損失的免責。
8.準據法：與本協議有關的事項，均應適用中華人民共和國（但不含港澳臺地區）的法律與政策（ “適用法律與政策”）。該等適用法律與政策可能不時變動，因此，若因適用法律與政策發生變化，導致使用者和/或美圖公司在本協議的權益有所增減，均不構成本協議的全部或某項條款自然無效或終止可執行性的依據，除非變更的該等適用法律與政策屬於強制有效的規定。
9.法律爭議管轄：若在使用者與美圖公司之間出現與本協議和/或與美顏相機相關的法律爭議，只要發生時，適用法律與政策允許將廈門美圖網科技有限公司所在地作為唯一或其中之一的爭議司法管轄領地，使用者即同意由廈門美圖網科技有限公司所在地具有管轄權的地方法院獨自審理該項爭議。
美圖公司及其所屬控制方（“美圖”、“我們”或“我們的”）致力於保護我們使用者（“使用者”或“您”）的隱私權。本隱私權政策(“本政策”)旨在向您說明，在使用我們的服務時，我們如何收集、存儲、使用和管理這些資訊。這些資訊包括您向我們提供的個人資訊或者我們透過網站或行動應用終端裝置收集到的相關資訊。收集途徑主要包括：www.meitu.com、www.meipai.com 和www.beautyplus.com (“我們的網站”)，或其他行動設備上（如：蘋果設備和Android設備）提供的美圖應用程式產品(“我們的服務”)。請注意，本政策範圍僅限於您使用我們的服務時向美圖提交或美圖收集的資訊。

為了向您提供更好的服務，我們將在法律允許的範圍內，僅止於您使用某些功能或服務時，收集您的相關資料和資訊。
在您使用我們的服務時，我們可能建議您註冊一個美圖帳號，以方便您充分利用我們的服務及其優勢。當您註冊美圖帳號時，我們會收集您所提供可作為身分辨識的資訊，包括您的帳號名稱、行動電話號碼等註冊美圖帳號必要資訊。
當您在行動平台上使用任何美圖應用程式時，我們可能收集並記錄某些資訊，比如您的產品唯一身分辨識（持續／間斷）、硬體種類、介質存取控制（“MAC”）位址、國際行動電話設備辨識碼（“IMEI”）、您的作業系統（“OS”）版本、設備名稱和所在地（根據您的網路通訊協定（“IP”）位址、SIM卡國家碼、GPS）。此資訊有助於我們解決問題並瞭解總體使用者使用傾向。
我們可能收集您的位置資訊以向您提供正確的應用程式版本及更優質的服務。除本政策另有約定外，我們不會與任何協力廠商分享這項資訊。如果您不再希望我們跟蹤或使用這項資訊，您可以在設備上關閉網路、GPS功能或者禁用我們獲取您網路、GPS、設備資訊許可權。
此外我們可能建立唯一使用者身分辨識以追蹤您對我們服務使用情況。此唯一使用者身分辨識會同您的個人資料儲存，以便於瞭解您正在使用的美圖應用程式。
當您使用我們的服務，包括參與、產生、瀏覽與我們的服務相關內容時，我們將會自動收集美圖應用程式內某些相關日誌資訊，包括：(1)關於您的使用時間與使用頻率的細節；(2)設備統計資訊、關鍵操作路徑、錯誤日誌、崩潰記錄、語言和時區等。這些日誌資訊能説明我們更瞭解並改善我們的服務，並非用於辨別任何特定個人。
中繼資料通常是與使用者內容相關聯的技術資料，簡而言之，它是描述資料的資料。例如，它可以描述圖片（或同類檔）內含地理位置資訊及建檔時間、圖片人物概略特徵和圖片內容。當您使用我們的服務時，我們將利用照片中繼資料為您提供更精准的“人臉檢測”，“關鍵點標記”，“區域分割”，“內容標籤”以及由這些基礎功能組合而成的其他客製化功能。正常情況下，這些中繼資料無法用於辨識任何特定個人，其是為了改善服務，並非用於辨識任何特定個人。
