1.本协议的范围:本协议是您与氧气相机公司及其相关服务可能存在运营关联公司(“关联公司”)之间关于您使用氧气相机所订立的协议。本协议的内容同时包括《美图帐号规则》与《隐私政策》。氧气相机公司及其关联公司可能根据自身对商业、法律与政策等要素的判断,随时更新本协议;若您无法接受本协议未来更新版本的全部或者部分条款,可联系氧气相机公司,在您未与氧气相机公司沟通一致前,请停止使用氧气相机。

2.用户信息与个人信息保护:保护您的用户信息与个人信息是氧气相机公司及其关联公司的一项基本原则。您同意,氧气相机公司及其关联公司将按照本协议及《隐私政策》的规定收集、使用、存储、管理和保护您的用户信息与个人信息;若您不同意或无法接受《隐私政策》全部或者部分条款或者有疑问的,请停止使用氧气相机并可根据首部联系方式与我们联系。

3.美图帐号与安全:为更好地使用氧气相机,您可自行注册美图帐号或者在使用其他方式登录情况下随机生成美图帐号;关于您使用美图帐号的具体规则,请遵守《美图帐号规则》规定。请您在获得美图帐号后自行妥善保管帐号及密码或者其他登录方式下的帐号及密码;因您保管不善可能导致美图帐号与密码失窃、帐号被盗用等情况,责任由您自行承担。您可根据《美图帐号规则》规定随时终止您的帐号,美图公司也将根据《美图帐户规则》规定管理您的帐号。

4.您的必要授权与同意:您利用氧气相机拍摄或者制作的信息内容(“用户内容”)中所含有的知识产权归您所有。您同意授予氧气相机公司一项为提供本服务、优化本服务和宣传推广本服务之目的所必须的免费、非独占、可在全球范围内收集、使用、存储、管理和保护您在本服务过程中产生的用户内容。氧气相机公司将根据《隐私政策》并尽最大努力在合理范围内使用用户内容,且您的必要授权与同意并不代表氧气相机公司对用户内容的必然使用,也不改变您对用户内容的所有权及其知识产权归属,更不影响您对用户内容任何合法使用。

5.您的合法使用:您应对使用氧气相机所拍摄、制作、发布或者储存的图片等数据信息的真实性、合法性负责。您不得使用氧气相机制作、储存或发布如下信息内容:

(1) 危害国家及社会安全信息,其表现可能包括但不限于反对宪法所确定的基本原则;危害国家安全,泄露国家机密,颠覆国家政权,破坏国家统一;煽动民族仇恨、民族歧视,破坏民族团结;破坏国家宗教政策,宣扬邪教和封建迷信;散布谣言,扰乱社会秩序,破坏社会稳定;宣扬赌博、暴力、凶杀、恐怖或者教唆犯罪;煽动非法集会、结社、游行、示威、聚众扰乱社会秩序;含有法律、行政法规和国家规定禁止的其他内容。

(2) 淫秽色情信息,其表现可能包括但不限于发布淫秽、色情内容,包括但不限于招嫖、寻找一夜情、性伴侣等内容;发布以色情为目的的情色文字、情色视频、情色图画等内容;长期发布与淫秽、色情内容擦边的或具有性暗示类的内容。

(3) 侵权信息,其表现可能包括但不限于制作、发布、储存侵犯他人名誉权、肖像权、隐私权、知识产权等合法权利的内容。

(4) 不正当竞争信息,其表现可能包括但不限于发布篡改、增减、删除权利标识的内容;发布未经授权方授权的内容等。

(5) 其他违反法律法规、政策以及社会公序良俗或干扰氧气相机正常运营及侵犯任何第三方合法权益的信息。

若您违反本协议,您同意氧气相机公司有权根据自身的判断或法律与政策的需要,自主决定并可在不预先通知您的情况下,全部或者部分地选择:(1)暂停或终止对您的软件使用许可并停止相应技术服务,采取包括但不限于限制、冻结或终止美图帐号使用措施,并由您自行承担美图帐号无法使用后果;和(2)诉诸行政执法机构或者司法机关,以追究相应法律责任。若因您违反本协议导致任何第三方损害的(含氧气相机公司及其关联公司),您应当独立承担责任;氧气相机公司及其关联公司遭受损失的,您也应当一并赔偿。

6.广告:氧气相机中可能包括广告,这属于氧气相机公司及其关联公司合理合法的商业模式,您同意在使用氧气相机过程中接收由氧气相机公司及其关联公司或者其第三方合作伙伴发布的广告信息。氧气相机公司及其关联公司依照法律的规定对广告信息发布履行相关义务后,您应当自行判断广告信息的真实性并为自己的判断行为负责,除法律明确规定外,您因依该广告信息进行的交易或广告主提供的内容而遭受的损失或损害,氧气相机公司及其关联公司不承担责任。

7.知识产权声明:氧气相机本身自带的所有版本、技术、程序、素材、道具和所有的信息内容(“氧气相机信息内容”,包括但不限于产品功能、用户界面、操作步骤、商标、专利、计算机软件作品等)的知识产权均归氧气相机公司、氧气相机公司许可方或氧气相机公司关联公司所有,氧气相机公司及其关联公司对您的软件使用许可在任何情况下均不应视为向您转让其知识产权的部分或者全部。您通过氧气相机下载、使用的任何素材及其他氧气相机信息内容,仅限您个人娱乐、学习、研究或者欣赏使用,未经氧气相机公司书面同意,不可用于任何商业用途。

8.不可抗力与其他免责事由:氧气相机在使用中会受到包括但不限于如下不可抗力或者其他因素的影响:政治原因、社会环境、自然灾害、经济危机、计算机病毒或黑客攻击、服务器或系统不稳定、您所在的特殊位置、任何技术能力、网络质量以及通信线路、计算机故障等(以下统称“免责事由”)。若出现上述免责事由情况时,氧气相机公司将尽努力在第一时间进行修复或者及时补救,给您造成损失的,氧气相机公司在法律与政策允许的范围内免责。

9.氧气相机变更、中断与终止:除本协议其他约定外,氧气相机公司及其关联公司还有权根据自己独立商业判断对氧气相机内容进行变更、中断或终止。除其他协议另有规定外,氧气相机公司不对相应变更、中断或终止承担任何责任,您应妥善做好数据更新、备份与转移工作。

10.适用法律与纠纷管辖:本协议成立、生效、履行、解释及纠纷解决,均适用中华人民共和国大陆地区法律(不包括冲突法)。本协议签订地为中华人民共和国福建省厦门市思明区。若在您与氧气相机公司及其关联公司之间发生的任何纠纷或争议,您同意将该纠纷或者争议提交本协议签订地有管辖权的人民法院排他管辖。本协议条款无论何种原因部分无效或不可执行,其他条款仍应继续有效,对双方具有约束力。

11.定义及其他

(1)“氧气相机”是指氧气相机公司及其关联公司开发、运营、管理的一款应用软件产品,旨在为您提供本协议范围内免费、非独占和全球范围内的软件使用许可及技术服务。本协议项下的“氧气相机”根据不同的语境将可能指氧气相机移动端、氧气相机公司为氧气相机设立的独立网站或者氧气相机公司围绕氧气相机软件产品提供的相关技术服务。

(2)“氧气相机公司”指厦门鸿天科技有限公司。

(3)“素材”指由氧气相机公司提供的已经内置于氧气相机的或者未来即将内置的包括但不限于字体、文字、特效、贴纸、边框、背景、模板等用于美化您照片的相关素材与信息。






隐私政策

我们非常重视您的隐私权!

氧气相机公司及其关联控制方(“氧气相机”、“我们”或“我们的”)致力于保护我们用户(“用户”或“您”)的隐私权。本隐私政策(“本政策”)旨在向您说明,在使用我们的网站和我们的服务时,我们如何收集、存储、使用、管理和保护您的用户信息(包括个人信息)。收集途径主要包括:移动设备上(如:苹果设备和安卓设备)提供的氧气相机应用程序产品(“我们的服务”),特定氧气相机应用程序产品提供独立的隐私政策的除外。

请注意,本政策范围仅限于您使用我们的网站和我们的服务时向氧气相机提交或者氧气相机收集的用户信息(包括个人信息);本政策下“个人信息”指信息本身或与氧气相机能够访问的个人的其他信息联系后能够识别特定个人的数据,包括您的姓名、地址、电话号码和电子邮箱地址。

使用我们的网站和我们的服务就意味着您同意本政策,并同意根据本政策中规定的方式对您的用户信息(包括您的个人信息)进行收集、处理、披露和分享。如果您不同意本政策及未来修订版本的任何条款,请不要使用我们的网站和我们的服务。

我们收集哪些信息

为了向您提供我们的网站和我们的服务,我们将在法律允许的范围内和当且仅当您浏览网站、使用某些功能或者服务时,根据本政策规定收集您的个人信息和用户信息。如果您不提供这些信息,我们可能无法向您提供我们的产品或服务。

您提供给我们的信息

在您使用我们的网站和我们的服务时,我们可能会建议您注册一个氧气相机帐号(如有),以方便您充分利用我们的网站、我们的服务及其优势。当您注册氧气相机帐号时,我们会收集您所提供的可识别您身份的信息,这些信息包括您的帐号名称、移动电话号码等注册氧气相机帐号所必须的信息。在您在申请开通美拍视频直播功能时(如有),我们将根据法律规定要求您提供本人真实有效的身份信息(包括但不限于姓名、身份证号和手机号码)以供实名认证。

设备信息

当您在移动设备上使用我们的服务时,我们收集与您设备相关的信息。例如,国际移动电话设备识别码(“IMEI”)、广告标识符(“IDFA”与“IDFV”)、集成电路卡识别码(“ICCID”)和介质访问控制(“MAC”)地址、设备型号与设备分辨率,方便我们统计使用我们产品与服务的设备数量并进行设备机型数据分析与图形适配分析。

网络信息

当您在连网状态下使用我们的网站或我们的服务时,我们收集您所使用的运营商名称与网络类型,目的是为了解用户的运营商和网络分布的情况,此外,我们还收集接入WIFI名称与WIFI接入时间以了解您使用服务的用户场景。

位置信息

我们收集您的位置信息,如国家代码、经纬度信息、网络位置、IP地址和系统设置国家及时区信息。这些信息有助于我们了解用户分布和用户使用场景,使我们可以为其提供正确的应用程序版本及更优质的服务。除本政策另有约定外,我们不会与任何第三方分享这些信息。如果您不再希望我们跟踪或使用具体位置信息,您可以在选择在设备上关闭网络、GPS功能或者禁用我们获取您网络、GPS、设备信息权限。

日志信息

当您使用某些我们的服务,包括参与、生成、浏览与我们的服务相关的内容时,我们将会自动收集氧气相机应用程序产品内某些相关的日志信息,这些信息包括:(1)关于您的使用时间与使用频率的细节;(2)设备统计信息、关键操作路径、错误日志、崩溃记录、语言和时区等。这些日志信息能够帮助我们更好的了解和改善我们的服务,并非用于识别任何特定的个人。

图片信息

当您选择使用我们的服务中的云美化功能时,请您理解并且同意,为实现向您提供该项服务并作持续优化之目的,我们须将您的图片上传至我们的服务器进行处理完毕后再将处理后图片返回给您;在此过程中,我们还将同步收到您的图片的EXIF信息(根据设备厂商的不同,Exif信息可能包括图片拍摄与处理时的GPS、设备型号、感光度(ISO)、前后置摄像头与创建时间信息等),以供进一步优化我们的服务。

元数据

元数据通常是与用户内容相关联的技术数据,简而言之,它是描述数据的数据。例如,它可以描述图片(或同类文件)中包含的地理位置信息及文件创建时间,图片中包含的粗略人物特征和图片中包含的内容。当您在使用我们的服务时,我们将利用照片元数据为您提供更精准的“人脸检测”,“关键点标记”,“区域分割”,“内容标签”以及由这些基础功能组合而成的其他定制功能。正常情况下,这些元数据无法用于识别任何特定的个人。这些元数据是为了改进服务目的,并非用于识别任何特定的个人。

论坛信息

部分我们的网站或者应用程序提供面向公众的社区论坛。请知悉,如果您在这些网站或者应用程序上公开发布了信息,任何可登录到该网站的用户都将可以阅读到您的信息,或收集、使用。如您自己无法将您的个人信息从社区论坛中删除,请联系我们:support@meitu.com或者legal@meitu.com。有时,我们可能无法删除您的个人信息,在这种情况下我们会将这一情况及其原因告知于您。

Cookie

只在您浏览我们的网站时,氧气相机或氧气相机委托合作第三方使用cookie、标签和脚本等技术,收集日志文件和本地缓存信息,用于分析趋势、管理网站、追踪用户的网站活动并收集关于整个用户群的人口统计信息。日志文件信息可能包括互联网协议 (IP) 地址、浏览器类型、互联网服务供应商 (ISP)、引用/退出页面、操作系统、日期/时间戳和点击流数据。

广告信息

我们可能在服务中放映广告并且可能出于追踪广告目的收集并使用有关您的信息,例如您的设备标识符、MAC地址、IMEI、地理位置及IP地址。这些信息是为了用于创建内部用户编号以帮助我们更好地计数和追踪基于语言、地理位置和其他细节的广告。我们不会将这些信息出售给第三方。

我们还可能收集其他各类与个人没有关联的信息。例如,操作系统类型与版本号以了解系统升级情况、系统语言以用于语言适配、应用列表以了解用户的兴趣偏好等。收集此类信息的目的在于改善我们向您提供的服务。

适用法律

本政策更新

您同意,我们根据法律法规或者氧气相机商业决策相应更新本政策,您愿意受修订后政策的约束。如果涉及本政策重大变更,在必要时我们将以网站公告或者信息推送方式做出。

Important: Before you (also the "user") read and decide whether to accept this O2Cam Terms of Service (the "Agreement"), O2Cam advises you to carefully read and understand the provisions of this Agreement that are underlined and in bold, which exclude or limit the liability of O2Cam and which place significant obligations upon the user. If you are a minor, please read and decide whether to accept this Agreement in the company of your legal guardian. If you have any questions about this Agreement, or reject this Agreement in whole or in part, or wish to provide feedback (including suggestions and complaints) to O2Cam on your use of O2Cam, please cease using O2Cam and contact us via QQ at 800019025, via email at support@meitu.com/legal@meitu.com, or by phone at 0086 592 5320520.

1. Scope of this Agreement: This Agreement governs your use of O2Cam and is made between you, O2Cam and its affiliates (also “Affiliates”) that may provide related services. This Agreement covers the MTid Regulations and Privacy Policy. O2Cam or its Affiliates may update this Agreement at any time at their discretion for business, legal or policy reasons. If you reject all or part of any future updated version of this Agreement, you may contact O2Cam and must cease using O2Cam unless and until you reach an agreement with O2Cam.

2. Protection of User Information and Personal Details: It is the policy of O2Cam and its Affiliates to protect your user information, including your personal details. You agree that O2Cam and its Affiliates shall collect, use, store, manage and protect your user information and personal details in accordance with the provisions of this Agreement and the Privacy Policy. If you do not consent to, or are unable to accept, the provisions of the Privacy Policy in whole or in part or have any questions, please cease using O2Cam and you may contact us at the number provided above.

3. MTid & Security: You may register for an MTid yourself or generate a random MTid by logging in via another method in order to better utilize our services. Please follow the rules listed in our MTid Regulations at all times. Please properly keep the account and password of your MTid or of the account and password which you used to log in to our application. If you fail to do so and your MTid or password is lost or stolen, you shall be responsible for all losses that are incurred. You may terminate your account any time following the rules listed in the MTid Regulations. O2Cam will also be managing your account according to the MTid Regulations.

4. Your Grant of License and Agreement: You shall have the intellectual property rights to the photos taken or processed by you using O2Cam ("User Content"). You agree to grant O2Cam a royalty-free, non-exclusive, worldwide license to collect, use, store, manage and protect the User Content generated by you using O2Cam for the purposes of offering, optimizing and promoting O2Cam. O2Cam will make reasonable use of the User Content in accordance with the Privacy Policy, and your grant of this license and agreement do not imply the guaranteed use of the User Content by O2Cam, nor will it change your ownership of the User Content or the intellectual property rights thereof, nor will it affect your legal use of the User Content.

5. Your Legal Use of O2Cam: You shall be liable for the authenticity and legality of the photos taken, created, posted or stored by you using O2Cam. You shall not use O2Cam to create, store or post the following information:

(i) Information that endangers national and social security, including but not limited to information that opposes the fundamental principles stated in the Constitution; information that endangers national security, divulges state secrets, subverts state power or undermines national unity; information that incites ethnic hatred or discrimination or undermines ethnic solidarity; information that undermines national religious policies or propagates cults or superstitions; information that disseminates rumors, disturbs social order or disrupts social stability; information that propagates gambling, violence, murder or terrorism or incites crime; information that incites unlawful assembly, association, procession or demonstration, or gathers crowds to disturb social order; any other information prohibited by law, administrative regulations or national regulations;

(ii) Obscene and pornographic information, including but not limited to information related to solicitation of prostitutes, casual sex, and sexual partners, and information related to the posting of content such as erotic texts, erotic videos, erotic pictures, and information related to long-term posting of content of a probable obscene and pornographic nature or any other content of a suggestive sexual nature;

(iii) Information that infringes on the rights of others, including but not limited to their legitimate rights under the law, including the right to a sound reputation, the right of publicity, the right to privacy and intellectual property rights;

(iv) Information that creates unfair competition, including but not limited to information related to the tampering, adding, subtracting and deleting of ownership markings, or information related to the posting of unauthorized content, or other kinds of similar information; or

(v) Any other information that violates the laws, regulations, policies, social order, and good customs, interferes with the normal operations of O2Cam, or infringes on the legitimate rights and interests of any third party.

If you violate this Agreement, you agree that O2Cam may, at its discretion or as required by law and policies, and without prior notice to you, (1) suspend or terminate the software license granted to you and cease to provide technical services, including but not limited to limit, freeze or terminate your use of MTid, and you shall be liable for being unable to use MTid; and/or (2) refer you to an administrative enforcement agency or judiciary authority to assess your legal liability. You shall be solely liable for any damage caused to any third party (including O2Cam and its Affiliates) as a result of your violation of this Agreement, and agree to compensate O2Cam and its Affiliates for any losses thus incurred.

6. Advertising: O2Cam may include advertising. Advertising is part of the reasonable and lawful business model of O2Cam and its Affiliates. You agree to receive advertising released by O2Cam and its Affiliates or third-party partners while using O2Cam. After O2Cam and its Affiliates have performed their obligations in connection with the release of advertisements according to law, you shall make your own judgment about the authenticity of such advertisements and shall be liable for your judgment. Unless otherwise stipulated by law, O2Cam and its Affiliates are not liable for any losses or damage incurred by you as a result of transactions resulting from such advertisements or content provided by advertisers.

7. Intellectual Property Rights Notice: The intellectual property rights for all versions, technologies, programs, material, items and all information provided with O2Cam (collectively referred to as "O2Cam Information", including but not limited to product features, user interfaces, operating steps, trademarks, patents, computer software) shall be vested in O2Cam, or O2Cam's licensors or Affiliates. The grant of a license to you by O2Cam and its Affiliates to use the software provided shall in no event be deemed a transfer to you of all or part of the intellectual property rights therein. You may only use any material you download from O2Cam, or any other O2Cam content or information for the purpose of your personal recreation, learning, research or appreciation. You may not use such material, content, or information for any commercial purposes without the written consent of O2Cam.

8. Force Majeure and Other Grounds for Exemption from Liability: Your ability to use O2Cam may be affected by the following: political factors, the social environment, natural disasters, economic crises, attacks from computer viruses or hackers, server or system instability, your location, technical limitations, network quality and failures in communication lines or computers (hereinafter collectively referred to as "grounds for exemption from liability"). In the event of any of such grounds for exemption from liability, O2Cam will make every endeavor to restore normal operations and thereby remove the grounds for exemption as soon as possible. During this period, OO2Cam shall be exempt from liability for losses incurred by you to the extent permitted by law and policies.

9. Modification, Interruption and Termination of O2Cam: Except as otherwise stipulated in this Agreement, O2Cam and its Affiliates shall have the right to modify, interrupt, or terminate O2Cam content based on their sole business judgment. Except as otherwise stipulated in other applicable agreements, O2Cam is not liable for losses resulting from any such modifications, interruptions or terminations. It is your responsibility to update, back up and transfer your data.

10. Governing Law and Dispute Resolution: This Agreement is established, enters into force, and shall be enforced and interpreted under the law of mainland China, without regard to its conflict of laws provisions. Any disputes arising hereunder shall also be resolved in accordance with the law of this jurisdiction. This Agreement is entered into force in Siming District, Xiamen, Fujian Province, People's Republic of China. You agree to submit any disputes between you and O2Cam or any of its Affiliates to a people's court with jurisdiction in the place where this Agreement was entered into for exclusive jurisdiction. If any provision of this Agreement is held to be invalid or unenforceable for whatever reason, the remaining provisions shall remain in full force and effect and binding upon you and O2Cam.

11. Definitions and Miscellaneous

(i) “O2Cam” is an app developed, operated and managed by O2Cam and its Affiliates that aims to provide you with a free, non-exclusive and worldwide software license and technical services within the scope of this Agreement. In this Agreement, "O2Cam" may refer to any O2Cam mobile client, the independent website set up by O2Cam for O2Cam or the technical services provided by O2Cam in connection with the O2Cam app.

(ii) "O2Cam" refers to Xiamen Hongtian Chuangshi Technology Co., Ltd.

(iii) "Material" refers to material and information that have been provided by O2Cam and built into O2Cam, or that will be provided by O2Cam and built into O2Cam, and can be used to edit your photos. Such material and information include but are not limited to fonts, text, filters, stickers, frames, backgrounds and templates.

This log information will be used by us to better understand and improve our Services, and will not be used to identify you.

Image Information

By choosing to use the cloud editing feature of our service, you understand and agree that we must upload your photos to our server for processing before returning processed photos to you for the purposes of providing such service to you and continuous optimization and that we will also receive the EXIF data about your photos (EXIF data may contain GPS coordinates where photos were taken and processed, equipment type, ISO and information about the front and rear cameras and creation time, depending on the equipment manufacturer) for the purpose of further optimizing our services.

Metadata

Metadata refers to technical data associated with user content. Put simply, metadata is data that describes data. For example, metadata can describe the location information and file creation time contained in photos or other files, or the rough features of the characters in photos and other content contained in photos. When you use our Services, we will use photo metadata to provide you with certain features including precise "Facial Recognition", "Key-Points Recognition", "Region Segmentation", "Content Tags" and other custom features based on a combination of these basic features. Metadata cannot normally be used to identify a specific individual; it will be used to improve our Services.

Forum Posts

Some of our Sites or applications offer publicly accessible community forums. You should be aware that any information about you provided or posted by you on these forums may be read, collected or used by anyone who accesses these forums. You may remove your personal details from these community forums by yourself, or you may contact us at support@meitu.com or legal@meitu.com, requesting us to remove your personal details. Sometimes, we may be unable to remove your personal details from these community forums, in which case we will notify you of this and the reason why.

1. Scope of this Agreement: This Agreement governs your use of O2Cam and is made between you, O2Cam and its affiliates (also “Affiliates”) that may provide related services. If you reject all or part of any future updated version of this Agreement, you may contact O2Cam and must cease using O2Cam unless and until you reach an agreement with O2Cam.

2. Protection of User Information and Personal Details: It is the policy of O2Cam and its Affiliates to protect your user information, including your personal details. You agree that O2Cam and its Affiliates shall collect, use, store, manage and protect your user information and personal details in accordance with the provisions of this Agreement and the Privacy Policy. If you do not consent to, or are unable to accept, the provisions of the Privacy Policy in whole or in part or have any questions, please cease using O2Cam and you may contact us at the number provided above.

3. MTid & Security: You may register for an MTid yourself or generate a random MTid by logging in via another method in order to better utilize our services. Please follow the rules listed in our MTid Regulations at all times. Please properly keep the account and password of your MTid or of the account and password which you used to log in to our application. If you fail to do so and your MTid or password is lost or stolen, you shall be responsible for all losses that are incurred. You may terminate your account any time following the rules listed in the MTid Regulations. O2Cam will also be managing your account according to the MTid Regulations.

4. Your Grant of License and Agreement: You shall have the intellectual property rights to the photos taken or processed by you using O2Cam ("User Content"). You agree to grant O2Cam a royalty-free, non-exclusive, worldwide license to collect, use, store, manage and protect the User Content generated by you using O2Cam for the purposes of offering, optimizing and promoting O2Cam. O2Cam will make reasonable use of the User Content in accordance with the Privacy Policy, and your grant of this license and agreement do not imply the guaranteed use of the User Content by O2Cam, nor will it change your ownership of the User Content or the intellectual property rights thereof, nor will it affect your legal use of the User Content.

5. Your Legal Use of O2Cam: You shall be liable for the authenticity and legality of the photos taken, created, posted or stored by you using O2Cam. You shall not use O2Cam to create, store or post the following information:

(i) Information that endangers national and social security, including but not limited to information that opposes the fundamental principles stated in the Constitution; information that endangers national security, divulges state secrets, subverts state power or undermines national unity; information that incites ethnic hatred or discrimination or undermines ethnic solidarity; information that undermines national religious policies or propagates cults or superstitions; information that disseminates rumors, disturbs social order or disrupts social stability; information that propagates gambling, violence, murder or terrorism or incites crime; information that incites unlawful assembly, association, procession or demonstration, or gathers crowds to disturb social order; any other information prohibited by law, administrative regulations or national regulations;

(ii) Obscene and pornographic information, including but not limited to information related to solicitation of prostitutes, casual sex, and sexual partners, and information related to the posting of content such as erotic texts, erotic videos, erotic pictures, and information related to long-term posting of content of a probable obscene and pornographic nature or any other content of a suggestive sexual nature;

(iii) Information that infringes on the rights of others, including but not limited to their legitimate rights under the law, including the right to a sound reputation, the right of publicity, the right to privacy and intellectual property rights;

(iv) Information that creates unfair competition, including but not limited to information related to the tampering, adding, subtracting and deleting of ownership markings, or information related to the posting of unauthorized content, or other kinds of similar information; or

(v) Any other information that violates the laws, regulations, policies, social order, and good customs, interferes with the normal operations of O2Cam, or infringes on the legitimate rights and interests of any third party.

If you violate this Agreement, you agree that O2Cam may, at its discretion or as required by law and policies, and without prior notice to you, (1) suspend or terminate the software license granted to you and cease to provide technical services, including but not limited to limit, freeze or terminate your use of MTid, and you shall be liable for being unable to use MTid; and/or (2) refer you to an administrative enforcement agency or judiciary authority to assess your legal liability. You shall be solely liable for any damage caused to any third party (including O2Cam and its Affiliates) as a result of your violation of this Agreement, and agree to compensate O2Cam and its Affiliates for any losses thus incurred.

6. Advertising: O2Cam may include advertising. Advertising is part of the reasonable and lawful business model of O2Cam and its Affiliates. You agree to receive advertising released by O2Cam and its Affiliates or third-party partners while using O2Cam. After O2Cam and its Affiliates have performed their obligations in connection with the release of advertisements according to law, you shall make your own judgment about the authenticity of such advertisements and shall be liable for your judgment. Unless otherwise stipulated by law, O2Cam and its Affiliates are not liable for any losses or damage incurred by you as a result of transactions resulting from such advertisements or content provided by advertisers.

7. Intellectual Property Rights Notice: The intellectual property rights for all versions, technologies, programs, material, items and all information provided with O2Cam (collectively referred to as "O2Cam Information", including but not limited to product features, user interfaces, operating steps, trademarks, patents, computer software) shall be vested in O2Cam, or O2Cam's licensors or Affiliates.
