1.本协议的范围：本协议是您与美图公司及其相关服务可能存在运营关联公司（“关联公司”）之间关于您使用潮自拍所订立的协议。本协议的内容同时包括《美图帐号规则》、《潮自拍社区管理规则》、《潮自拍权益纠纷投诉处理规则》与《隐私政策》。美图公司及其关联公司可能根据自身对商业、法律与政策等要素的判断，随时更新本协议；若您无法接受本协议未来更新版本的全部或者部分条款，可联系美图公司,在您未与美图公司沟通一致前,请停止使用潮自拍。
2.用户信息与个人信息保护：保护您的用户信息与个人信息是美图公司及其关联公司的一项基本原则。您同意，美图公司及其关联公司将按照本协议及《隐私政策》的规定收集、使用、存储、管理和保护您的用户信息与个人信息；若您无法接受《隐私政策》全部或者部分条款或者有疑问的，请停止使用潮自拍并可根据首部联系方式与我们联系。
3.美图帐号与安全：为更好地使用潮自拍，您可自行注册美图帐号或者在使用其他方式登录情况下随机生成美图帐号；关于您使用美图帐号的具体规则，请遵守《美图帐号规则》规定。请您在获得美图帐号后自行妥善保管帐号及密码或者其他登录方式下的帐号及密码；因您保管不善可能导致美图帐号与密码失窃、帐号被盗用等情况，责任由您自行承担。您可根据《美图帐号规则》规定随时终止您的帐号，美图公司也将根据《美图帐户规则》规定管理您的帐号。
4.用户使用方式：您同意按照本协议约定方式合理合法地使用潮自拍。除非另有约定，您通过潮自拍观看、分享、保存、使用、传播、发布的任何图片、视频及其他内容，仅限您个人的非商业性质用途；未经美图公司书面同意，您不得有偿或者无偿转让依本协议条款所取得的用户权利。
5.您的必要授权：您利用潮自拍拍摄或者制作的信息内容（“用户内容”）中所含有的知识产权归您所有。您同意授予美图公司一项为提供本服务、优化本服务和宣传推广本服务之目的所必须的免费、非独占、可在全球范围内收集、使用、存储、管理和保护您在本服务过程中产生的用户内容。美图公司将根据《隐私政策》并尽最大努力在合理范围内使用用户内容，且您的必要授权与同意并不代表美图公司对用户内容的必然使用，也不改变您对用户内容的所有权及其知识产权归属，更不影响您对用户内容任何合法使用。
6.用户内容发布规范：您应对使用潮自拍发布的用户内容的真实性、合法性负责。如需获得该信息内容权利人或任何有权第三方（包括但不限于其他网络平台等，以下统称“授权方”）的事先授权或批准的，应事先获得该等授权或批准；一旦您发布某项信息内容，将被视为您已事先获得该等授权或批准（如有）。您同意严格遵守《潮自拍社区管理规则》，不得直接或间接发布如下信息：
若您违反本协议和/或《潮自拍社区管理规则》，您同意美图公司有权根据自身的判断或法律与政策的需要，自主决定并可在不预先通知您的情况下，全部或者部分地选择：（1）暂停或终止对您的软件使用许可并停止相应技术服务，采取包括但不限于限制、冻结或终止美图帐号使用措施，并由您自行承担美图帐号无法使用后果；和（2）诉诸行政执法机构或者司法机关，以追究相应法律责任。若因您违反本协议导致任何第三方损害的（含美图公司及其关联公司），您应当独立承担责任；美图公司及其关联公司遭受损失的，您也应当一并赔偿。
7.投诉举报处理：美图公司倡议您共同参与维护及监督潮自拍使用环境的合规与清洁。无论是美图公司主动发现用户的不当、违法行为，或者是美图公司根据举报、投诉并初步查实用户存在不当、违法行为，美图公司均有权立即在无事先通知的情况下采取必要的措施以制止该等行为的继续进行。具体以《潮自拍社区管理规则》和《潮自拍权益纠纷投诉处理规则》约定为准。
8.增值服务：美图公司及其关联公司有权针对部分服务以收费方式提供，如您使用收费服务，请遵守相关的协议。若您不同意相关协议及其修改和变更，请暂停使用增值服务并可按照首部联系方式与美图公司进行联系。若您为未满18周岁未成年人，请您在法定监护人陪同下，认真仔细阅读增值服务相关协议并选择是否接受该协议及其服务。
9.广告：潮自拍中可能包括广告，这属于美图公司及其关联公司合理合法的商业模式，您同意在使用潮自拍过程中接收由美图公司及其关联公司或者其第三方合作伙伴发布的广告信息。美图公司及其关联公司依照法律的规定对广告信息发布履行相关义务后，您应当自行判断广告信息的真实性并为自己的判断行为负责，除法律明确规定外，您因依该广告信息进行的交易或广告主提供的内容而遭受的损失或损害，美图公司及其关联公司不承担责任。
10.知识产权声明：潮自拍本身自带的所有版本、技术、程序、素材、道具和所有的信息内容（“潮自拍信息内容”，包括但不限于产品功能、用户界面、操作步骤、商标、专利、计算机软件作品等）的知识产权均归美图公司、美图公司许可方或美图公司关联公司所有，美图公司及其关联公司对您的软件使用许可在任何情况下均不应视为向您转让其知识产权的部分或者全部。您通过潮自拍下载、使用的任何素材及其他潮自拍信息内容，仅限您个人娱乐、学习、研究或者欣赏使用，未经美图公司书面同意，不可用于任何商业用途。
11.不可抗力与其他免责事由：潮自拍在使用中会受到包括但不限于如下不可抗力或者其他因素的影响：政治原因、社会环境、自然灾害、经济危机、计算机病毒或黑客攻击、服务器或系统不稳定、您所在的特殊位置、任何技术能力、网络质量以及通信线路、计算机故障等（以下统称“免责事由”）。若出现上述免责事由情况时，美图公司将尽努力在第一时间进行修复或者及时补救，给您造成损失的，美图公司在法律与政策允许的范围内免责。
12.潮自拍变更、中断与终止：除本协议其他约定外，美图公司及其关联公司还有权根据自己独立商业判断对潮自拍内容进行变更、中断或终止。除其他协议另有规定外，美图公司不对相应变更、中断或终止承担任何责任，您应妥善做好数据更新、备份与转移工作。
13.适用法律与纠纷管辖：本协议成立、生效、履行、解释及纠纷解决，均适用中华人民共和国大陆地区法律（不包括冲突法）。本协议签订地为中华人民共和国福建省厦门市思明区。若在您与美图公司及其关联公司之间发生的任何纠纷或争议，您同意将该纠纷或者争议提交本协议签订地有管辖权的人民法院排他管辖。本协议条款无论何种原因部分无效或不可执行，其他条款仍应继续有效，对双方具有约束力。

1. Scope of this Agreement: This Agreement is made between you and Meitu and its affiliates (the “Affiliates”), where its related services may exist and governs your use of SelfieCity. This Agreement covers the Meitu Account Regulations, the Community Management Regulations for SelfieCity, the Rules for Handling of Disputes over Interests in SelfieCity and the Privacy Policy. Meitu and its Affiliates may update this Agreement at any time at their discretion in accordance with business, legal or policy reasons. If you are unable to accept all or part of the provisions of any future updated version of this Agreement, you may contact Meitu Please cease the use of SelfieCity prior to you reaching an agreement with Meitu.
2. Protection of User Information and Personal Information: It is a fundamental principle of Meitu and its Affiliates to protect your user information and personal information. You agree that Meitu and its Affiliates shall collect, use, store, manage and protect your user information and personal information in accordance with the provisions of this Agreement and the Privacy Policy. If you are unable to accept the provisions of the Privacy Policy in whole or in part or have any questions, please cease using SelfieCity and you may contact us via the contact details provided above.
3. Meitu Account and Security: To make better use of SelfieCity, you can register for a Meitu account yourself or create a Meitu account at random using any other methods of logging in. With regards to the specific regulations on the use of your Meitu account, please comply with the provisions of the Meitu Account Regulations. After getting your Meitu account, please keep your Meitu account and password as well as your account and password related with other login methods secure. You shall be solely liable for situations such as theft of your Meitu account and password, or any unauthorized use of your Meitu account due to your failure to keep this information secure. You may terminate your Meitu account at any time in accordance with the Meitu Account Regulations. Meitu shall also manage your Meitu account in accordance with the Meitu Account Regulations.
4. Your Use of Meitu: You agree to use SelfieCity in a reasonable and legal manner as stipulated in this Agreement. Unless otherwise stated, you may use photos, videos and other content viewed, shared, stored, used, transmitted and posted by you using SelfieCity for your personal, non-commercial purposes only, and you may not transfer your rights under this Agreement, whether for a consideration or free of charge, without the written consent of Meitu.
5. Your Grant of License: You shall own the intellectual property rights to the photos taken or processed by you using SelfieCity (“User Content”). You agree to grant Meitu. a royalty-free, non-exclusive, worldwide license to collect, use, store, manage and protect the User Content generated by you using Meitu for the purposes of offering, optimizing and promoting Meitu. Meitu. will make reasonable use of the User Content in accordance with the Privacy Policy, and your grant of this license and agreement do not imply the guaranteed use of the User Content by Meitu, nor will it change your ownership of the User Content or the intellectual property rights thereof, nor will it affect your legal use of the User Content.
6. Rules for Posting User Content: You shall be liable for the authenticity and legality of the User Content posted by you using SelfieCity. If any posting of any User Content by you is subject to prior authorization or approval from the owner thereof or any authorized third party (such as any other network platform, hereinafter referred to collectively as the “Licensor”), you shall obtain such prior authorization or approval before posting such User Content. By posting any User Content, you will be deemed to have obtained the required authorization or approval (if any) with respect thereto. You agree to strictly comply with the Community Management Rules for SelfieCity and not to post the following information, either through direct or indirect methods:
If you violate this Agreement and/or the Community Management Rules for SelfieCity, you agree that Meitu may, at its discretion or as required by law and policies, and without prior notice to you, (1) suspend or terminate the software license granted to you and cease to provide technical services, and take measures including but not limited to restricting your use of your Meitu Account or freezing or terminating your Meitu Account at the risk of you being unable to use your Meitu Account; and/or (2) refer you to an administrative enforcement agency or judiciary authority to assess your legal liability. You shall be solely liable for any damage caused to any third party (including Meitu and its affiliates) as a result of your violation of this Agreement, and agree to compensate Meitu and its affiliates for any losses thus incurred.
7. Handling of Complaints and Reports: Meitu encourages you to join in safeguarding and supervising the compliance and integrity of the environment for use of SelfieCity. Meitu has the right to immediately take necessary measures, with no prior notice, to stop any user from any misconduct or illegal behavior, whether identified by Meitu or verified by Meitu, based on any report or complaint, in accordance with the Community Management Regulations for SelfieCity and the Rules for Handling of Disputes over Interests in SelfieCity.
8. Value-added Services: Meitu and its Affiliates is entitled to charge fees for certain services provided ("Value-added Services"). If you choose to use those Value-added Services, the relevant agreement shall be complied. If you do not agree to the relevant agreement and its amendments and modifications, please suspend your use of the Value-added Services. You may contact Meitu via contact details as first written above. If you are minor(s) under 18 years of age, please read the relevant the agreement on Value-added Services carefully and decide whether to accept the agreement and the Value-added Services thereof in the company of your legal guardian.
9. Advertising: SelfieCity may include advertisements, which are part of the reasonable and legitimate business model adopted by Meitu and its Affiliates. You agree to receive advertisements sent by Meitu and its Affiliates or third-party partners while you are using SelfieCity. After Meitu and its Affiliates have performed their obligations in connection with the release of advertisements in according with the law, you shall make your own judgment about the authenticity of such advertisements and shall be liable for the consequences of your judgment. Unless otherwise stipulated by law, Meitu and its Affiliates are not liable for any losses or damages incurred by you from the transactions performed based on such advertisements or the content provided by the advertisers.
10. Intellectual Property Rights Statement: Meitu, or parties licensed by Meitu, or Affiliates of Meitu have ownership of the intellectual property rights in all versions, technologies, programs, materials, items and all information provided along with SelfieCity (collectively referred to as "SelfieCity Information Content", including but not limited to product features, user interfaces, operating steps, trademarks, patents, computer software, etc.). Under any circumstances, the granting of a license to you by Meitu or its Affiliates to use the software provided by Meitu shall not be deemed as a transfer to you of all or part of the intellectual property rights therein. Any material that you download from SelfieCity and any other SelfieCity contents may be used for the purpose of your personal entertainment, learning, research or appreciation. You shall not use such material and content for any commercial purposes without the written consent of Meitu
11. Force Majeure and Other Grounds for Exemption from Liability: Your ability to use SelfieCity may be affected by force majeure circumstances or other factors, including but not limited to the following: Political or social circumstances, natural disasters, economic crises, computer virus or hacker attacks, server or system instability, your location, technical limitations, network quality, and failures in communication lines or computers (hereinafter collectively referred to as "grounds for exemption from liability").In the event of any of such grounds for exemption from liability, Meitu shall make every endeavor to restore the normal operations or take timely remedial actions as soon as possible. During this period, Meitu shall be exempted from liability for losses incurred by you to the extent permissible by law and relevant policies.
12. Modification, Suspension, and Termination of SelfieCity:Except as otherwise stipulated in this Agreement, Meitu and its Affiliates shall have the right to modify, suspend, or terminate content in SelfieCity in accordance with their sole business judgment. Except as otherwise stipulated in any other agreements, Meitu shall not assume any responsibility for any corresponding modification, suspension or termination. It is your responsibility to appropriately update, backup and transfer the data.
13. Governing Law and Dispute Resolution: This Agreement is established, enters into force, and shall be enforced and interpreted under the laws of mainland China, without regard to its conflict of laws provisions. Any disputes arising hereunder shall also be resolved in accordance with the laws of this jurisdiction. This Agreement is entered into force in Siming District, Xiamen, Fujian Province, People's Republic of China. You agree to submit any dispute between you and Meitu or any of its Affiliates to the court with jurisdiction in the place where this Agreement has been entered into for exclusive jurisdiction. If any provision of this Agreement is held to be invalid or unenforceable for whatever reason, the remaining provisions shall remain in full force and effect and binding upon you and Meitu

1. Scope of this Agreement: This Agreement is made between you and Meitu and its affiliates (the “Affiliates”), where its related services may exist and governs your use of SelfieCity. This Agreement covers the Meitu Account Regulations, the Community Management Regulations for SelfieCity, the Rules for Handling of Disputes over Interests in SelfieCity and the Privacy Policy. Meitu and its Affiliates may update this Agreement at any time at their discretion in accordance with business, legal or policy reasons. If you are unable to accept all or part of the provisions of any future updated version of this Agreement, you may contact Meitu Please cease the use of SelfieCity prior to you reaching an agreement with Meitu.
2. Protection of User Information and Personal Information: It is a fundamental principle of Meitu and its Affiliates to protect your user information and personal information. You agree that Meitu and its Affiliates shall collect, use, store, manage and protect your user information and personal information in accordance with the provisions of this Agreement and the Privacy Policy. If you are unable to accept the provisions of the Privacy Policy in whole or in part or have any questions, please cease using SelfieCity and you may contact us via the contact details provided above.
3. Meitu Account and Security: To make better use of SelfieCity, you can register for a Meitu account yourself or create a Meitu account at random using any other methods of logging in. With regards to the specific regulations on the use of your Meitu account, please comply with the provisions of the Meitu Account Regulations. After getting your Meitu account, please keep your Meitu account and password as well as your account and password related with other login methods secure. You shall be solely liable for situations such as theft of your Meitu account and password, or any unauthorized use of your Meitu account due to your failure to keep this information secure. You may terminate your Meitu account at any time in accordance with the Meitu Account Regulations. Meitu shall also manage your Meitu account in accordance with the Meitu Account Regulations.
4. Your Use of Meitu: You agree to use SelfieCity in a reasonable and legal manner as stipulated in this Agreement. Unless otherwise stated, you may use photos, videos and other content viewed, shared, stored, used, transmitted and posted by you using SelfieCity for your personal, non-commercial purposes only, and you may not transfer your rights under this Agreement, whether for a consideration or free of charge, without the written consent of Meitu.
5. Your Grant of License: You shall own the intellectual property rights to the photos taken or processed by you using SelfieCity (“User Content”). You agree to grant Meitu. a royalty-free, non-exclusive, worldwide license to collect, use, store, manage and protect the User Content generated by you using Meitu for the purposes of offering, optimizing and promoting Meitu. Meitu. will make reasonable use of the User Content in accordance with the Privacy Policy, and your grant of this license and agreement do not imply the guaranteed use of the User Content by Meitu, nor will it change your ownership of the User Content or the intellectual property rights thereof, nor will it affect your legal use of the User Content.
6. Rules for Posting User Content: You shall be liable for the authenticity and legality of the User Content posted by you using SelfieCity. If any posting of any User Content by you is subject to prior authorization or approval from the owner thereof or any authorized third party (such as any other network platform, hereinafter referred to collectively as the “Licensor”), you shall obtain such prior authorization or approval before posting such User Content. By posting any User Content, you will be deemed to have obtained the required authorization or approval (if any) with respect thereto. You agree to strictly comply with the Community Management Rules for SelfieCity and not to post the following information, either through direct or indirect methods:
If you violate this Agreement and/or the Community Management Rules for SelfieCity, you agree that Meitu may, at its discretion or as required by law and policies, and without prior notice to you, (1) suspend or terminate the software license granted to you and cease to provide technical services, and take measures including but not limited to restricting your use of your Meitu Account or freezing or terminating your Meitu Account at the risk of you being unable to use your Meitu Account; and/or (2) refer you to an administrative enforcement agency or judiciary authority to assess your legal liability. You shall be solely liable for any damage caused to any third party (including Meitu and its affiliates) as a result of your violation of this Agreement, and agree to compensate Meitu and its affiliates for any losses thus incurred.
7. Handling of Complaints and Reports: Meitu encourages you to join in safeguarding and supervising the compliance and integrity of the environment for use of SelfieCity. Meitu has the right to immediately take necessary measures, with no prior notice, to stop any user from any misconduct or illegal behavior, whether identified by Meitu or verified by Meitu, based on any report or complaint, in accordance with the Community Management Regulations for SelfieCity and the Rules for Handling of Disputes over Interests in SelfieCity.
8. Value-added Services: Meitu and its Affiliates is entitled to charge fees for certain services provided ("Value-added Services"). If you choose to use those Value-added Services, the relevant agreement shall be complied. If you do not agree to the relevant agreement and its amendments and modifications, please suspend your use of the Value-added Services. You may contact Meitu via contact details as first written above. If you are minor(s) under 18 years of age, please read the relevant the agreement on Value-added Services carefully and decide whether to accept the agreement and the Value-added Services thereof in the company of your legal guardian.
9. Advertising: SelfieCity may include advertisements, which are part of the reasonable and legitimate business model adopted by Meitu and its Affiliates. You agree to receive advertisements sent by Meitu and its Affiliates or third-party partners while you are using SelfieCity. After Meitu and its Affiliates have performed their obligations in connection with the release of advertisements in according with the law, you shall make your own judgment about the authenticity of such advertisements and shall be liable for the consequences of your judgment. Unless otherwise stipulated by law, Meitu and its Affiliates are not liable for any losses or damages incurred by you from the transactions performed based on such advertisements or the content provided by the advertisers.
10. Intellectual Property Rights Statement: Meitu, or parties licensed by Meitu, or Affiliates of Meitu have ownership of the intellectual property rights in all versions, technologies, programs, materials, items and all information provided along with SelfieCity (collectively referred to as "SelfieCity Information Content", including but not limited to product features, user interfaces, operating steps, trademarks, patents, computer software, etc.). Under any circumstances, the granting of a license to you by Meitu or its Affiliates to use the software provided by Meitu shall not be deemed as a transfer to you of all or part of the intellectual property rights therein. Any material that you download from SelfieCity and any other SelfieCity contents may be used for the purpose of your personal entertainment, learning, research or appreciation. You shall not use such material and content for any commercial purposes without the written consent of Meitu
11. Force Majeure and Other Grounds for Exemption from Liability: Your ability to use SelfieCity may be affected by force majeure circumstances or other factors, including but not limited to the following: Political or social circumstances, natural disasters, economic crises, computer virus or hacker attacks, server or system instability, your location, technical limitations, network quality, and failures in communication lines or computers (hereinafter collectively referred to as "grounds for exemption from liability").In the event of any of such grounds for exemption from liability, Meitu shall make every endeavor to restore the normal operations or take timely remedial actions as soon as possible. During this period, Meitu shall be exempted from liability for losses incurred by you to the extent permissible by law and relevant policies.
12. Modification, Suspension, and Termination of SelfieCity:Except as otherwise stipulated in this Agreement, Meitu and its Affiliates shall have the right to modify, suspend, or terminate content in SelfieCity in accordance with their sole business judgment. Except as otherwise stipulated in any other agreements, Meitu shall not assume any responsibility for any corresponding modification, suspension or termination. It is your responsibility to appropriately update, backup and transfer the data.
13. Governing Law and Dispute Resolution: This Agreement is established, enters into force, and shall be enforced and interpreted under the laws of mainland China, without regard to its conflict of laws provisions. Any disputes arising hereunder shall also be resolved in accordance with the laws of this jurisdiction. This Agreement is entered into force in Siming District, Xiamen, Fujian Province, People's Republic of China. You agree to submit any dispute between you and Meitu or any of its Affiliates to the court with jurisdiction in the place where this Agreement has been entered into for exclusive jurisdiction. If any provision of this Agreement is held to be invalid or unenforceable for whatever reason, the remaining provisions shall remain in full force and effect and binding upon you and Meitu
